Sub.:  Crew Layover Accommodation at HONGKONG

 

It is proposed to provide accommodation to the Crew of National Aviation Company of India Limited (Air India) in Five Star or Four Star or equivalent Hotels at Hong Kong with effect from 1st April, 2010.

 

GENERAL TERMS & CONDITIONS

 

1.         Air India’s present requirement is approximately 20 rooms per day for the accommodation of Cockpit crew/Cabin Crew. This may increase/decrease depending on the flight pattern of operations and the type of aircraft.

 

2.         The hotel is required to bid for the total room requirement. In case the hotel is not able to bid for the total room requirement for whatever reasons, the hotel may indicate the maximum rooms the hotel can provide to Air India for Crew layover accommodation. Air India may at its discretion, accommodate crew in more than one hotel in case one hotel is unable to provide all the rooms required.

 

3.         Air-India will be billed on the actual rooms utilised on a 24-hours check out basis. 

 

No overlapping charges would be applicable for a check out exceeding 24 hours by 4 hours due to flight delays/exigencies etc. In the event of check out exceeding four hours but up to eight hours 50% of the room rent will be payable. After eight hours full rate will be applicable.

 

4.            Pattern of operations will be given to the hotel at the time of signing the contract and in case of reduction/increase of rooms, Air-India Ltd. will advise the Hotel suitably.

 

5.         Room & Breakfast Charges – The room rate should be inclusive of breakfast and internet, further giving breakup of room rate, breakfast rate, internet charges, applicable taxes (if any), etc.

 

6.            Porterage Services – All crew baggage shall be collected from the crew bus on arrival and delivered to the rooms and collected from the rooms to the crew bus during departure. 

 

7.            Laundry FacilityThe Hotel should indicate the availability of Laundry/Pressing facility.

 

8.         Crew Transportation Clarification to be given regarding whether the Hotel will arrange transportation from Hotel/Airport/Hotel for the Crew.      

 

9.         Cash Float -            Allowances to be disbursed to Crew Members in cash in Local Currency / USD. A deposit will be maintained with the hotel by Air India and reimbursed on a fortnightly basis as per the requirement.

 

10.       The Health Club - Should be adequately equipped with the latest equipment and should be made available to the crew on a complimentary basis.

 

11. Contract Period      The contract shall be at least for a period of two years which may be extendable by another one year on the same rates, terms and conditions, if mutually agreed with an exit clause.

 

 

12.       Exit Clause 

a)  The agreement can be terminated with 60 days written notice by either party with valid reasons for giving termination notice.

            b) Unless both the parties have mutually agreed for an extension, the contract stands automatically terminated on its expiry date and no notice of termination will be required.

 

13.       Terms of Payment     Bills for actual occupancy to be raised on monthly basis on NACIL and submitted to Air-India’s local Accounts Department.  Bills are generally settled within 30 days period from the date of receipt of the bill.  Separate bills to be raised for room charges and for disbursement of allowances, if any.

 

14.       Force Majeure – Air India will be exempt from obligations if prompt notification is given in the event of suspension of flights/operations to the station, change in Crew layover pattern, circumstances or causes beyond the control of either of the parties.

 

 

15. Validity of financial bids:

 

i.                    The price quoted in the financial bid should be valid for a period of 90 days from the date of opening of the financial bid.

 

ii.                  The financial bids of only those short-listed Hotels that have qualified in the technical evaluation will be opened. The decision of NACIL (Air India) on technical bid evaluation will be final. Only the short-listed Hotels on technical evaluation will be advised of the date of opening of the financial bids.

 

iii.                The Contracted rates for crew lay over accommodation would be applicable to other officials/executives of the Company while on official visit to the station and the passengers of delayed and cancelled flights. In the event of non-availability of committed rooms to the crew for whatsoever reason, alternate accommodation is to be arranged by the Hotel in other Hotels / Rooms of a comparable standard. If the Hotel is not able to arrange for the alternate accommodation, the Company may arrange the accommodation and debit the difference in cost to the Hotel along with penalty, if any.

 

 

iv.                 NACIL (Air India) reserves the right to reject all or any of the Tenders at any stage without assigning any reasons whatsoever and the decision of NACIL (Air India) on the matter will be final and binding on the parties.

 

v.                   Conditional Offer will not be accepted.

 

vi.                 Any deviation in submitting the tenders as prescribed or any incomplete tenders are liable for rejection.  Quotes should be submitted in the Financial Bid format both in words and figures.  In case of any variation or correction, the quote given in words will be taken for evaluation and award of contract.

 

vii.               Your quotation shall also be rejected in case of the following:-

 

a)  Quotation received after due date and time.

a.   Only single bid i.e. Technical or Financial bid received.

b.   Quotation received by fax/email.

c.   Quotation received unsigned.

d.    Quotation not received in separate sealed envelopes.

 

viii.             Jurisdiction: In respect of any matter arising out of this contract, the Courts of Law  in India shall have the exclusive jurisdiction and both the parties submit to the said jurisdiction.

 

ix.                 Criteria for shortlisting hotels:

 

i)        The hotel should be 5 or 4 star or its equivalent.

ii)      It should have 24 hours room or coffee shop.

iii)    Adequate internal security.

iv)    Doctor available on request.

v)      The hotel should be located in a safe area.

vi)    The hotel should offer health club facility.

vii)  The hotel should provide porterage from crew transport to the rooms and vice versa.

viii)            Availability of laundry facility.

 

(x)  Arbitration: Any dispute or difference whatsoever arising between the parties out of or relating to the construction, interpretation, application, meaning, scope, operation or effect of this contract or the validity or the breach thereof, shall be settled by conciliatory arbitration in accordance with the Rules of Arbitration of the “Scope Forum of Conciliation and Arbitration” and the award made in pursuance thereof shall be binding on the parties.

 

 

(z)  Additional facilities required without any additional payment,  but to cover within the quoted room rates.

 

i)        24 hours Room Service facility.

ii)      Provision of mineral water.

iii)    Provision of tea/coffee in the room/bed tea.

iv)     Free local telephone calls.

v)       Provision of newspapers.

vi)     Adequate internal security

vii)   Medical Practioner to be available on request.

vi)      Crew lounge with all standard facilities including internet facility.

16.       Mode of Submission of Tender – The tender should be submitted in a Two Bid System i.e. in two separate sealed envelopes as follows:

 

Envelope No.I containing the Technical Bid, duly super-scribed as “Technical Bid” and Name of the Hotel.  It may please be noted that any mention of financial details in this envelope will render the offer invalid.

 

Envelope No.II containing the Financial Bid in the prescribed format, duly super-scribed as “Financial Bid” and Name of the Hotel.

 

The above arrangement is necessary as these two separate sealed envelopes will be opened at two different times.

 

Both these sealed envelopes i.e. Envelope No.I & Envelope No.II should be placed in a single large sealed envelope, duly super-scribing NAME OF THE HOTEL and TENDER FOR CREW LAYOVER ACCOMMODATION AT Hong Kong. This envelope should be then submitted to The Station Manager, at the following office or before 10th March 2010.

17.        In case of any deviation in submitting the quotes as prescribed, or any overwriting or incomplete tenders, the quotations will be rejected.
